Terms of Use (EULA)

These Terms of Use ("Terms") are a legal agreement between you and Vici Tech Solutions ("we," "us," or "our") governing your use of our mobile applications, including CyberCert AI (each, an "App"). By downloading, installing, or using an App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service. This license is supplemented by Apple's standard Licensed Application End User License Agreement where applicable.

2. The Service

CyberCert AI is a free, ad-supported study tool that provides practice questions, mock exams, study analytics, and an AI-powered tutor to help you prepare for cybersecurity certification exams. The App is an independent study aid. It is not affiliated with, endorsed by, or sponsored by CompTIA, ISC2, EC-Council, or any other certification vendor. All practice questions are original study material created independently and inspired by publicly available exam objectives; they are not real, leaked, or actual exam questions.

3. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account.

4. Advertising

The App is provided free of charge and is supported by advertising. The App may utilize device data to serve relevant advertisements through Google Ads. Your interaction with those advertisements may be subject to Google's terms and privacy policies. See our Privacy Policy for details on how device data is used for advertising.

5. AI-Generated Content

The App uses artificial intelligence to generate explanations, tutoring responses, and practice content. AI output may contain errors or inaccuracies and is provided for educational purposes only. It does not constitute professional advice, and we do not guarantee that studying with the App will result in passing any certification exam. Always verify important information against official exam objectives and study materials.

6. Acceptable Use

You agree not to: (a) reverse engineer, decompile, or disassemble the App; (b) copy, resell, or redistribute App content, including practice questions; (c) use the App to develop a competing product; (d) attempt to extract or misuse the AI features, including generating unlawful, harmful, or infringing content; (e) circumvent security mechanisms; or (f) use the App in violation of any applicable law.

7. Intellectual Property

The App, including its software, design, question bank, and content, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. Certification names mentioned in the App (e.g., Security+, CISSP, CEH) are trademarks of their respective owners and are used solely to identify exam topics.

8. Third-Party Services

The App relies on third-party services, including Amazon Web Services (hosting and AI) and Google Ads (advertising). Your use of those services may be subject to their own terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it from your device.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or this page, and the "Last updated" date will be revised. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Apple-Specific Terms

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-law principles, except where the consumer protection laws of your country of residence provide otherwise.
